Website Terms of Use
These Website Terms of Use (“Terms”) govern your access to and use of nitinsbajaj.com (the “Website”), operated by Nitin Bajaj (“Nitin,” “I,” “me,” or “my”).
By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.
Separate contracts, proposals, booking conditions, releases, payment terms, confidentiality obligations, or other agreements may apply to a speaking engagement, media appearance, working session, operating-leadership engagement, recording, partnership, or other service.
1. Website Purpose
The Website provides information concerning speaking and moderation, operating leadership, media appearances, The INDUStry Show, ASAN and community activities, professional background and experience, business working sessions, articles, interviews, recordings, and media resources, and methods for submitting inquiries and scheduling time.
Website content is provided for general informational purposes.
2. No Professional Advice
Nothing on the Website constitutes legal advice, tax advice, financial or investment advice, accounting advice, medical or mental-health advice, immigration advice, employment advice, securities advice, a valuation, a recommendation to buy, sell, invest in, operate, acquire, or dispose of a business, or a guarantee of business, professional, financial, legal, or personal results.
Statements regarding businesses, acquisitions, growth, operations, leadership, fundraising, community-building, or other experience are contextual and should not be treated as instructions for a particular situation.
You are responsible for conducting your own evaluation and consulting qualified advisers before making significant decisions.
3. No Engagement or Relationship Created
Accessing the Website, submitting an inquiry, scheduling a call, sending information, or participating in an introductory conversation does not create a consulting relationship, advisory relationship, employment relationship, operating-leadership engagement, partnership, joint venture, fiduciary relationship, agency relationship, confidential relationship, attorney-client relationship, commitment to provide services, or guarantee that an inquiry will be accepted.
A professional engagement exists only when its material terms have been expressly accepted in a written agreement or other clear written confirmation.
Do not send confidential information before an appropriate relationship and method of communication have been established.
4. Inquiries
The Website allows users to submit inquiries concerning speaking, moderation, operating leadership, media, ASAN or community partnerships, and other matters.
You agree to provide information that is accurate to the best of your knowledge and that you are authorized to submit.
Submitting an inquiry does not guarantee a response, a meeting, acceptance, availability, a proposal, an introduction, a speaking or media engagement, an operating-leadership engagement, a partnership, or any particular outcome.
An inquiry may be accepted, declined, redirected, or left unanswered based on fit, availability, completeness, timing, capacity, or other reasonable considerations.
Statements regarding typical response times are goals rather than guarantees.
5. Scheduling
The Website may provide links for scheduling introductory telephone calls, invited video calls, approved recordings, paid working sessions, and other identified appointments.
You agree to select only the appointment type that accurately matches the purpose of the conversation.
A booking may be declined, cancelled, or rescheduled when you were not invited or authorized to use the selected calendar, you selected the wrong appointment type, the stated purpose is inaccurate or incomplete, the request is not a fit, a conflict, emergency, illness, travel issue, or technical problem occurs, or other reasonable circumstances require a change.
Scheduling a call does not create an obligation to pursue an engagement or transaction.
6. Paid Business Working Sessions
A paid business working session is a limited conversation focused on a specific business problem, decision, or opportunity identified by the purchaser.
Unless expressly stated otherwise, a working session does not include advance research, written deliverables, legal, tax, accounting, investment, medical, or other regulated professional advice, implementation, ongoing support, follow-up work, introductions, fundraising, a business valuation, review of extensive documents, or a guarantee of any outcome.
You remain responsible for all business decisions and actions taken after the session.
Information provided during the session should be sufficient to discuss the issue but should not include unnecessary trade secrets, personal data, privileged material, regulated information, or highly sensitive records.
Any cancellation, rescheduling, transfer, no-show, or refund terms displayed during booking or payment are incorporated into these Terms.
When no separate terms are displayed, a purchaser should provide reasonable notice of a requested change, rescheduling is subject to availability, missed sessions and late cancellations may be nonrefundable, and a refund may be provided when the session is cancelled by Nitin and cannot reasonably be rescheduled.
7. Speaking and Moderation
Website descriptions of speaking or moderation services are general and do not create a binding offer.
The scope of a speaking or moderation engagement may be governed by a separate written agreement addressing matters such as date and location, format, session length, preparation, participants, fees, travel, recording, content use, cancellation, force majeure, promotion, and technical requirements.
No date is considered confirmed until it is expressly confirmed in writing and any required agreement or payment has been completed.
Event organizers are responsible for providing accurate event information, appropriate facilities, lawful working conditions, and any permissions needed for recording, promotion, or participant participation.
8. Operating Leadership
Information concerning operating leadership is descriptive and does not constitute an offer to invest, acquire, manage, operate, advise, or become employed by a business.
Any operating-leadership engagement requires independent diligence and a separate written agreement.
Until such an agreement is executed, no duty to investigate or act exists, no exclusivity exists, no authority to represent or bind a business exists, no fiduciary or employment relationship exists, no confidential relationship should be assumed, and no compensation arrangement is established.
Statements about preferred company size, business profile, industries, compensation structure, or engagement duration are general guidelines and may change based on the circumstances.
9. Media and Recordings
The Website may provide information and materials for journalists, producers, podcast hosts, conference organizers, and other media professionals.
Approved biographies, headshots, topic documents, and press materials may be used only for legitimate editorial, event, interview, or promotional purposes directly related to Nitin Bajaj’s participation or coverage.
You may not materially alter a photograph or biography in a misleading manner, use an image or quotation to imply endorsement of an unrelated person, organization, product, service, political campaign, or cause, sell or sublicense press assets, use press assets for merchandise, or use materials after permission has been withdrawn where continued use is not otherwise legally permitted.
Recording, publication, ownership, editing, distribution, promotional use, and reuse may be governed by a separate written or recorded agreement.
An approved interview or recording may be cancelled or withheld from publication when material terms have not been honored, subject to applicable agreements and law.
10. Testimonials, Quotations, and Third-Party References
The Website may include testimonials, quotations, client or participant names, company names, event names, publications, university names, logos, and references to third parties.
Testimonials reflect the views and experiences of the individuals quoted. They do not guarantee that another person will receive the same result.
Third-party names, trademarks, and logos belong to their respective owners and are used for identification, commentary, biographical context, or to describe prior participation or experience.
Their appearance does not necessarily imply sponsorship, endorsement, employment, partnership, or an ongoing relationship.
11. Experience and Performance Statements
Statements concerning professional experience, revenue, acquisitions, fundraising, geographic operations, audience reach, events, partnerships, media reach, or other outcomes are based on records and information considered reasonable when published.
These figures may reflect cumulative results across multiple organizations, roles, projects, or periods; be rounded; include work completed with teams and organizations; change as new activity occurs; and not be independently audited unless expressly stated.
Past experience and results do not guarantee future performance.
12. ASAN and The INDUStry Show
The Website may refer or link to the American South Asian Network, Antha Prerna Foundation, The INDUStry Show, and other organizations, publications, or initiatives.
Those organizations, platforms, and initiatives may have separate ownership, governance, privacy policies, terms, participation requirements, and operational practices.
An inquiry submitted through this Website concerning ASAN or a community partnership may be referred to ASAN or Antha Prerna Foundation for review.
Use of an external ASAN or The INDUStry Show website is governed by the terms and policies displayed on that website.
13. Intellectual Property
Unless otherwise stated, the Website and its content, including text, graphics, designs, photographs, videos, audio, downloadable materials, presentations, documents, logos, and software, are owned by Nitin Bajaj or used with permission and are protected by applicable intellectual-property laws.
You are granted a limited, revocable, nonexclusive, nontransferable right to access and use publicly available Website content for personal, editorial, educational, or internal informational purposes.
Without prior written permission, you may not republish substantial Website content, reproduce complete articles, videos, presentations, or downloadable materials, sell, license, or commercially exploit Website content, create misleading derivative works, remove copyright, trademark, attribution, or ownership notices, use a name, image, voice, logo, biography, or likeness to imply endorsement, scrape or systematically extract Website content or data through automated means, or create a confusingly similar website, profile, publication, or brand.
You may share ordinary links to public Website pages and quote limited excerpts with appropriate attribution, subject to applicable law.
14. User-Submitted Materials
When you submit documents, messages, proposals, photographs, biographies, recordings, questions, or other materials, you retain any ownership rights you hold.
You grant permission to review, store, copy, and internally share the material as reasonably necessary to evaluate and respond to your inquiry or administer an agreed activity.
You represent that you have authority to submit the material, the information is accurate to the best of your knowledge, submission does not breach confidentiality or another agreement, the material does not infringe another person’s privacy, publicity, copyright, trademark, or other rights, and the material does not contain malware or unlawful content.
Submission does not guarantee review, return, acceptance, publication, confidentiality, or compensation.
15. Website Privacy and Cookies
The collection and use of information through the Website are described in the Privacy Policy, which is incorporated into these Terms by reference.
The Website may use cookies and similar technologies for essential functions and limited analytics.
Dismissing a cookie notice does not waive privacy rights or create consent where consent is legally required.
16. Appropriate Use
You agree not to use the Website for unlawful, fraudulent, deceptive, or abusive purposes; submit false, misleading, incomplete, or unauthorized information; impersonate another person or misrepresent your identity or authority; attempt to gain unauthorized access to systems, accounts, or information; interfere with Website operation or security; introduce malware, malicious code, automated attacks, or excessive traffic; circumvent technical limitations or security measures; scrape, harvest, or extract data through unauthorized automated means; use Website content in a manner that infringes another person’s rights; use the Website to transmit spam or unauthorized solicitations; or use contact information obtained through the Website for unrelated marketing or harassment.
Access may be restricted or terminated when the Website is reasonably believed to be misused.
17. Third-Party Websites and Services
The Website may link to external websites and services, including scheduling platforms, payment processors, video-conferencing services, publications, media platforms, social-media platforms, universities, companies, nonprofit organizations, event organizers, and business resources.
External websites and services are governed by their own terms and privacy policies.
I do not control and am not responsible for their content, representations, availability, privacy, security, products, services, or conduct.
A link or reference does not necessarily constitute endorsement.
18. Electronic Communications

Ordinary email, Website forms, telephone networks, and video platforms may not be completely secure.
Electronic communications may be delayed, intercepted, misdirected, corrupted, or incomplete.
Do not send highly sensitive or confidential information through an ordinary email or general Website form.
19. Website Availability and Changes

There is no guarantee that the Website will always be available, uninterrupted, error-free, secure, complete, accurate, or current.
Website content may become outdated. There is no obligation to update every historical page, article, quotation, reference, event, biography, statistic, or downloadable resource.
20. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
ALL EXPRESS AND IMPLIED WARRANTIES CONCERNING THE WEBSITE ARE DISCLAIMED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY.
NO WARRANTY IS MADE THAT WEBSITE CONTENT IS COMPLETE, ACCURATE, OR CURRENT; THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE; DEFECTS WILL BE CORRECTED; THE WEBSITE OR ITS SERVERS WILL BE FREE OF HARMFUL COMPONENTS; AN INQUIRY WILL BE ACCEPTED; A SESSION OR ENGAGEMENT WILL PRODUCE A PARTICULAR RESULT; OR A THIRD-PARTY WEBSITE, ORGANIZATION, PERSON, OR OPPORTUNITY WILL MEET YOUR EXPECTATIONS.
Nothing in these Terms excludes a warranty that cannot lawfully be excluded.
21. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NITIN BAJAJ AND ANY ASSOCIATED CONTRACTORS, REPRESENTATIVES, OR SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO ACCESS TO OR USE OF THE WEBSITE, INABILITY TO ACCESS OR USE THE WEBSITE, RELIANCE ON WEBSITE CONTENT, AN INQUIRY, BOOKING, CALL, OR WORKING SESSION, A BUSINESS, PROFESSIONAL, FINANCIAL, OR PERSONAL DECISION, A THIRD-PARTY WEBSITE, PLATFORM, PERSON, ORGANIZATION, OR SERVICE, DELAYED, LOST, OR INCOMPLETE ELECTRONIC COMMUNICATIONS, OR UNAUTHORIZED ACCESS OUTSIDE REASONABLE CONTROL.
Nothing in these Terms limits liability that cannot lawfully be limited, including liability arising from fraud, willful misconduct, or another category that applicable law prohibits from being excluded.
22. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Nitin Bajaj and associated contractors and representatives from claims, liabilities, losses, and reasonable costs arising from your unlawful or unauthorized use of the Website, information or materials you knowingly submit without authority, your violation of these Terms, your infringement of another person’s rights, or your fraud, unlawful conduct, or intentional misconduct.
This section does not require you to indemnify a protected party for that party’s own negligence, willful misconduct, or violation of law.
23. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Any legal action concerning these Terms or the Website must be brought in a state or federal court with jurisdiction in Orange County, California, unless applicable law requires otherwise.

24. Severability
If any provision of these Terms is found invalid, illegal, or unenforceable, that provision will be enforced to the greatest extent permitted and the remaining provisions will continue in effect.
25. No Waiver
A failure to enforce a provision of these Terms does not waive that provision or the right to enforce it later.
26. Entire Agreement Regarding Website Use
These Terms and the Privacy Policy constitute the entire agreement concerning use of the public Website.
They do not replace a separate speaking agreement, engagement agreement, booking condition, release, payment term, confidentiality agreement, operating agreement, or other contract.

These Terms may be revised periodically.
Revised Terms will be posted on this page with an updated effective date. Continued use of the Website after revised Terms are posted constitutes acceptance of the revised Terms, to the extent permitted by law.
